End User License Agreement for "Say It Without Saying It"

Agreement to Terms

By downloading, installing, or using "Say It Without Saying It" (the "App"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree to these terms, do not download, install, or use the App.

License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on Apple devices that you own or control
• Use the App for your personal, non-commercial entertainment purposes

License Restrictions

You agree NOT to:

• Copy, modify, adapt, alter, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
• Use the App for any commercial purpose without our express written permission
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to premium features or content
• Interfere with or disrupt the App's functionality or security features
• Use automated systems (bots, scripts) to interact with the App

Ownership

The App, including all content, features, functionality, graphics, user interface, and code, is owned by us and is protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any ownership rights in the App.

In-App Purchases

Premium Subscriptions

• The App offers premium subscriptions (monthly, yearly, and lifetime) that provide access to additional features and content
• Subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions
• Subscription fees are charged to your Apple ID account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage subscriptions and cancel them through your Apple ID account settings

Expansion Packs

• The App offers expansion packs that provide additional card categories
• Expansion packs are one-time purchases (non-consumable)
• Expansion packs require an active premium subscription to access
• Lifetime premium subscribers receive access to all current expansion packs

Purchase Terms

• All purchases are final unless required by law or as otherwise stated
• Refunds are subject to Apple's refund policy
• We reserve the right to modify pricing, features, or availability of in-app purchases at any time
• Purchases are tied to your Apple ID and can be restored on other devices using the same Apple ID

User Content

Game Statistics

• The App stores game statistics locally on your device
• You retain ownership of any data you create while using the App
• You are responsible for backing up your data if desired
• We are not responsible for any loss of data

User-Generated Content

• If you create custom content (such as custom cards), you grant us a license to use, modify, and display such content within the App
• You represent that any content you create does not violate any third-party rights or applicable laws

Updates and Modifications

• We may update the App from time to time to add features, fix bugs, or improve performance
• Updates may be automatic or require manual installation
• We reserve the right to modify, suspend, or discontinue any part of the App at any time
• We are not obligated to provide updates or support

Termination

By You

You may stop using the App at any time by deleting it from your device. This will not affect your in-app purchases, which remain tied to your Apple ID.

By Us

We may terminate or suspend your access to the App immediately, without prior notice, if you:

• Violate this EULA
• Engage in fraudulent, abusive, or illegal activity
• Use the App in a manner that could harm us or other users

Upon termination:

• Your right to use the App will immediately cease
• You must delete the App from all devices
• Your in-app purchases remain subject to Apple's terms

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, OR USE
• PERSONAL INJURY OR PROPERTY DAMAGE
• ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP

Our total liability shall not exceed the amount you paid for the App or in-app purchases in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of this EULA
• Your violation of any third-party rights
• Any content you create or submit

Apple-Specific Terms

This EULA is between you and us, not Apple. However, Apple and its subsidiaries are third-party beneficiaries of this EULA. Apple has no obligation to provide support for the App.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). Apple has no other warranty obligations.

Apple is not responsible for:

• Addressing any claims relating to the App
• Product liability claims
• Any failure of the App to comply with applicable legal requirements

Governing Law

This EULA shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from this EULA or your use of the App shall be resolved through:

Severability

Your continued use of the App after changes constitutes acceptance of the modified EULA.
